Mediation is a method of resolving disputes without going to trial. The mediator is a neutral third party who meets with all of the parties to a dispute. Although the mediator cannot impose a solution on the parties, the mediator’s goal is to help the parties create a solution to the dispute that all of the parties can agree on. Mediation is informal—no rules of evidence or procedure control the mediation. Most litigation now involves at least one attempt at mediation, either by court order or by agreement. Mediation is especially appropriate when the opposing party is someone you will continue to deal with--such as your employer, landlord, neighbor, or co-parent. Mediation can help you resolve your disagreement without destroying your relationship David L. Cook has completed training in Mediation and Family Mediation required by the Texas Civil Practice and Remedies Code to qualify for court appointment as a mediator.
